These Terms of Service (“Terms”) govern access to and use of the Advancify SaaS platform, APIs, demo environments, and related services (the “Service”).
The Service is provided by Advancify Limited, an Irish company (“Advancify”, “we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.
The Service is intended for business and organizational use only.
You represent that
you have the authority to bind your organization to these Terms.
Advancify SaaS provides APIs, analytics, and infrastructure that enable customers to process interaction-related biofeedback signals and generate non-medical, non-diagnostic insights for digital products.
Depending on configuration, certain raw interaction signals may be transmitted to and processed on Advancify servers. Such processing does not involve video, image, or audio data and is not intended for identification, authentication, or medical use.
Advancify may make available a demo or evaluation version of the Service upon request.
By accessing or using the demo version, you acknowledge and agree that certain raw interaction signals generated via device cameras may be transmitted to Advancify servers solely for demonstration and evaluation purposes.
These signals do not include video or image data and are processed only into non-medical, non-diagnostic metrics. Demo data is processed anonymously and is not used for identification, authentication, profiling, or medical purposes.

Advancify retains all rights, title, and interest in the Service, including software, APIs, algorithms, and documentation.
No rights are granted except as expressly stated in these Terms.
Fees, billing terms, and payment conditions are specified in applicable order forms or subscription agreements.
Advancify may suspend or terminate access to the Service if:
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
ADVANCIFY MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING ACCURACY, AVAILABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR RESULTS.
USE OF THE SERVICE DOES NOT GUARANTEE ANY BUSINESS, OPERATIONAL, FINANCIAL, OR PERFORMANCE OUTCOME. RESULTS MAY VARY OR NOT OCCUR AT ALL.
Customers acknowledge that they do not rely on the Service or its outputs as the sole basis for business, operational, safety, or compliance decisions.
Advancify does not guarantee that the Service will meet customer expectations or specific use cases.
To the maximum extent permitted by law, Advancify shall not be liable for indirect, incidental, or consequential damages.
Total liability shall not exceed the fees paid by the customer during the twelve (12) months preceding the claim.
If any dispute, claim, or controversy arises out of or relates to the Service, and such dispute is brought in the United States or involves U.S. persons, it shall be resolved by binding arbitration, rather than in court, except that claims may be brought in small claims court if eligible.
Disputes shall be resolved on an individual basis only. The parties waive any right to participate in a class, collective, or representative action.
This arbitration agreement is governed by the U.S. Federal Arbitration Act.
Customers may opt out of this arbitration agreement by providing written notice to Advancify within thirty (30) days of first accepting these Terms.
These Terms are governed by the laws of Ireland, except that arbitration provisions involving U.S. users are governed by the U.S. Federal Arbitration Act. Mandatory consumer protection laws remain unaffected.
We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.

Appendix: Demo and Evaluation Processing
This Appendix applies solely to demo and evaluation use of the Advancify SaaS platform.
During demo use, Advancify may act as a data processor for limited, anonymized interaction signal data generated via device cameras.
Processed data:
Demo data is retained for the minimum period necessary to support evaluation and is deleted thereafter.
Demo and Evaluation Processing:
Demo data does not constitute biometric identifiers or biometric information under applicable U.S. biometric privacy laws, including the Illinois Biometric Information Privacy Act (BIPA).
